These terms govern use of the Monkey Serve marketing website and related software / services. For contracted customers, the license or subscription agreement prevails if there is a conflict.
1. Acceptance
By using the site or the product, you accept these terms. If you disagree, do not use the site or software.
2. The product
Monkey Serve is a local-first POS for bars and restaurants (Windows terminals, waiter phone ordering on restaurant Wi‑Fi, printers, floor/tables, KDS), with an optional cloud portal for sync, licensing, analytics, and updates.
It is not a browser-only cloud POS for live floor operations. Printing and critical operations remain on your local infrastructure.
3. Accounts, PIN, and roles
Staff access is typically via PIN and roles (administrator, manager, waiter, kitchen). You are responsible for managing users, PINs, and permissions in your environment.
4. Subscription and license
Plans (e.g. Free / Pro / Enterprise) and portal / update features are defined by the commercial offer and subscription status. Non-payment or expiry may limit cloud services; local operation depends on your configuration and installed license.
5. Acceptable use
You may not misuse the software (e.g. bypass licensing, attack third-party systems, unlawful use of fiscal or customer data). You must comply with applicable law, including fiscalisation where required.
6. Intellectual property
Monkey Serve, the logo, brand, and code are owned by Monkey Serve / respective rights holders. You receive a limited, non-transferable license to use the software under contract — not ownership of the source code, unless agreed otherwise in writing.
7. Warranty and liability
Software is provided “as is”, within legal limits. We aim for stable operation but do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, our liability for damages arising from use of the product is limited to fees paid for subscription in the prior 12 months (or zero if unpaid). We are not liable for indirect business loss, mismanaged local data, or failures of your hardware / network.
8. Governing law
These terms are governed by the laws of the Republic of Albania, unless a separate contract says otherwise. Disputes are first addressed by negotiation; then by competent courts in Albania.
